This book deals with insolvency protocols, an instrument aimed at fostering cooperation among the courts and parties in multiple concurrent insolvency proceedings in several jurisdictions. It is based on the project “Transnational Protocols: A Cooperative Tool for Managing Cross-Border Insolvency” (ToP Project), funded by the European Union under the Justice Program. The project was attended by: “Università di Roma-La Sapienza”, “Università degli studi di Verona”, “Universidad Autónoma de Madrid” and “Martin-Luther-Universität, Halle-Wittenberg”. The main objective of the ToP Project has been to draft a European Model Protocol (EMP) with its guidelines to facilitate access to this cooperation tool in cross-border insolvencies. The book brings together the contributions of the project team. The idea that guided the leaders of the research groups was to leave the authors to express freely their opinions on the nature, content and effects of the protocols, independently of the clauses contained in the EMP (which together with the Guidelines are included in the appendix to the book itself).
